Falling Nikochan

As software

  • Falling Nikochan is open source software, and the source code is available on GitHub.

  • The source code is available under the AGPL-3.0-or-later.
    • The AGPL terms apply to any modifications or redistribution of the Falling Nikochan programs. (The full text of the AGPL-3.0 is here)
    • However, use of the Falling Nikochan API or embedding it in an iframe are free and not subject to the AGPL.
    • Additionally, the OpenAPI specification (/api/openapi.json) is freely available under the MIT License.
  • Images, audio, etc. used are released under CC-BY-4.0.
    • (Specifically, the files under the assets directory.)
    • Secondary use of these materials is free, as long as the copyright and license information is displayed. (About CC Licenses)
    • However, if you post gameplay videos, livestreams, or screenshots using this service to social media or video-sharing sites, you do not need to display the developer or license information even if Falling Nikochan images or audio are included.
  • You can check the third-party OSS libraries used by Falling Nikochan and their respective licenses below.

As a service

  • The following terms apply to users who use the Falling Nikochan service (hereinafter referred to as "this service") provided on the domain (nikochan*.utcode.net) managed by Falling Nikochan's developer (na-trium-144).
  • If a third party provides the Falling Nikochan service at a domain other than this, the developer is not involved in such use.

About user information

  • Falling Nikochan can be used without user registration. Users are not asked to enter personal information.
  • Play records of playing Falling Nikochan are sent to the server anonymously and stored. This does not include personal information such as cookies or IP addresses.
  • Falling Nikochan collects the following information to understand usage patterns and fix bugs. The data collected through these services is limited to statistical purposes and does not identify specific individuals.
    • Cloudflare Analytics: Used to understand access numbers and usage environment statistics. No cookies are used, and measurement is conducted in a privacy-conscious manner.
    • Sentry: If an error occurs while the site is running, error information is sent to a server managed by the developer to identify the cause. IP addresses and information that could identify users are not transmitted.
  • Play records such as the history of the charts played by users and best scores are stored in the Local Storage of the user's browser. This information is not transmitted to our servers or third parties.
  • Local Storage and Cookies are used to store passwords when users upload charts they created. They are not used to identify personal information.
  • On Mac Safari and iOS, these data stored in the browser may be deleted after a certain period of time. This is due to Apple's regulations and is not a bug of Falling Nikochan.
  • When a user creates and uploads a chart, the user's IP address is collected and stored. It is used for rate limiting of some APIs and may be used for other purposes if the developer deems it necessary, but it will not be provided to third parties.

About using YouTube videos

  • This service uses YouTube IFrame Player API.
    • YouTube IFrame Player API is a video embedding tool officially provided by YouTube. This service streams videos directly from YouTube, fully complying with its terms of service. This is different from downloading or storing videos that unofficial tools do.
    • Falling Nikochan is a service unrelated to YouTube. Please do not contact YouTube about this service.
  • The rights to the videos embedded in this service belong to the original video poster (or the copyright holder of the content used in that video). This service does not earn revenue from video playback, etc.
  • This service does not grant permission for secondary use of embedded videos. If you publish gameplay videos or livestreams using this service, you are responsible for complying with the policies of the respective rights holders regarding the music and video content from the embedded YouTube videos.

About uploading charts and copyright

  • This service allows anyone to upload charts without registering as a user. The chart uploaded by users is stored on Falling Nikochan's server.
  • When creating a chart, you can set an editing password.
  • Falling Nikochan does not provide a way to reset your password if you forget it. Please manage it at your own risk.
  • The copyright of chart data uploaded to this service belongs to the user who uploaded it.
    • However, the user grants this service the right to use such content free of charge and non-exclusively, to the extent necessary to provide and promote this service, including reproduction, distribution, display, and modification.
  • Please do not upload content that infringes copyright. In particular, do not use illegally uploaded videos or content that the copyright holder prohibits from being used in YouTube embedding on this service.
    • If there is a legitimate claim from a rights holder regarding copyright infringement, the developer may delete the relevant data from the server without prior notice.
    • If you believe data was deleted by mistake despite you having legitimate rights, you may file an objection. However, if identity verification is difficult, we may not be able to respond.

Prohibited acts

  • Do not place a load on the server with more access than necessary, or engage in any acts that disrupt the operation of the service, such as unauthorized access to the server.
  • If the data uploaded by the user is deemed by us to be inappropriate, such as content that violates laws, public order, or good morals, content that viewers find offensive, content that may interfere with operation of the service, or other inappropriate content, the developer may delete the relevant data from the server without prior notice.

Disclaimer

  • This service is a neutral platform that hosts content posted by users, and does not guarantee the legality of posted content. The developer shall not be liable for any trouble or damage related to posted content.
  • This service is provided "as is". The developer makes no warranties, express or implied, regarding this service, including its accuracy, currency, completeness, fitness for a particular purpose, or absence of security defects.
  • The developer shall not be liable for any damage incurred by users in connection with this service, except in cases of intentional misconduct or gross negligence by the developer.

Changes to, suspension of, etc. of the service

  • The developer may change these terms without notice. Users who continue to use the service are deemed to have agreed to the changes to these terms.
  • The developer may change or suspend all or part of the service without notice. The developer shall not be liable for any disadvantages or damages suffered by the user in connection therewith.
